The Core Guidelines

BuyPropertyinEurope is a dedicated website for independent estate agents and property developers wishing to advertise property for sale outside the United Kingdom.

BuyPropertyinEurope is a site for quality properties and consumers can expect high standards of business practice from those listing on the site.

1.0 The BuyPropertyinEurope Website

1.1 BuyPropertyinEurope shall create and maintain the BuyPropertyinEurope.com site.

1.2 BuyPropertyinEurope shall take such steps to market the site in the United Kingdom and in such other Countries as it considers necessary.

1.3 BuyPropertyinEurope shall create and maintain the technology for the design, presentation and operation of the site and own those components.

1.4 BuyPropertyinEurope will endeavour to maintain the operation of the site 24 hours x 7 days per week.

1.5 BuyPropertyinEurope shall take all reasonable steps to make the BuyPropertyinEurope site secure including the prevention of inappropriate, unauthorized or unlawful processing of personal data and accidental loss, damage or destruction of data.

1.6 BuyPropertyinEurope shall be entitled to remove any material from the BuyPropertyinEurope site where in the opinion of BuyPropertyinEurope its presence is contrary to these Conditions or is prejudicial to BuyPropertyinEurope or it’s Contributors.

1.7 If the BuyPropertyinEurope site is interrupted for any reason BuyPropertyinEurope will take all reasonable measures to minimise the length of the interruption.

1.8 BuyPropertyinEurope reserves the right to suspend the operation of the BuyPropertyinEurope site, in whole or in part, if it reasonably considers it appropriate to do so as a result of circumstances beyond its control.

1.9 All Contributors shall ensure they own the copyright and all other rights in the particulars of the properties they uplift to the BuyPropertyinEurope site.

2.0 The Consumer Proposition

2.1 In order to maintain the reputation of BuyPropertyinEurope with users, Contributors will ensure the representation and quality of their entries on the BuyPropertyinEurope site are the best reasonably attainable. BuyPropertyinEurope will have the right to issue guidelines as to the quality of entries listed on the site.

2.2 Contributors shall comply with service standards issued by BuyPropertyinEurope and updated from time to time.

2.3 The target for updating the listing is immediate with the requirement being to update within 24 hours in the event of a material change to listing particulars and/or property availability;

2.4 The target for responding to e-mails is the same working day with the requirement being by noon of the following day;

2.5 The target for responding to telephone calls is within two working hours with the requirement being 8 working hours.

2.6 Members will maintain a customer complaint procedure and have access to an independent dispute resolution procedure, which shall be notified to BuyPropertyinEurope.

3.0 The Business Standards

3.1 Contributors will at all times seek to comply with all legal and regulatory requirements, in particular:

3.3 Contributors shall ensure, monitor and maintain the accuracy and legality of the property particulars listed on the BuyPropertyinEurope site.

3.4 Contributors agree they will only uplift data (including without limitation photographs, maps and Personal data) which the Contributor and BuyPropertyinEurope are authorized to use display and transmit over the internet.

4.0 Liability and Indemnity

4.1 Contributors acknowledge computer software cannot be guaranteed error free and agree that BuyPropertyinEurope will not be liable for any errors in the software comprising the BuyPropertyinEurope site although BuyPropertyinEurope shall use all reasonable endeavours to correct any software errors that come to its attention.

4.2 Notwithstanding anything else in these Conditions BuyPropertyinEurope will not be liable to any Contributor for any:

4.3 Indirect or consequential loss whatsoever including, without limitation, loss of profit or contracts, or dishonest, fraudulent or malicious use of the BuyPropertyinEurope site by any person other than by its employees.

4.4 Notwithstanding anything else in these Conditions no Contributor will be liable to BuyPropertyinEurope for any:

4.5 Indirect or consequential loss whatsoever including, without limitation, loss of profit or contracts, dishonest, fraudulent or malicious use of the BuyPropertyinEurope site, other than as set out in this Agreement.

4.6 Where a party's liability has been excluded or restricted under these Conditions the other agrees and undertakes that, except in the case of fraud, it will not bring any claim against any of the first party's personnel under which their liability would be greater than the first party's liability.

4.7 Nothing in these Conditions shall limit either party's liability to the other for death or personal injury resulting from the negligence of itself or its personnel or for fraud.

4.8 Contributors shall indemnify and hold BuyPropertyinEurope harmless in respect of any claim brought against BuyPropertyinEurope in respect of their listed entries.

4.9 BuyPropertyinEurope’s liability to each Member for any claim whether under this Agreement, in contract, tort (including negligence), statute or otherwise (other than for death or personal injury) including breaches by a third party acting on behalf of BuyPropertyinEurope, shall be limited to €500 for anyone claim and not exceed that sum for any Contributor in any twelve months.

5.0 General

5.1 BuyPropertyinEurope may monitor Contributor transactional data and use such data for statistical and analytical purposes. Each Contributor’s transactional data shall remain confidential to it.

5.2 BuyPropertyinEurope may suspend listing a Contributor’s properties where in its opinion the Contributor is in material breach of these conditions pending conclusion of dispute resolution procedures.

5.3 Nothing in these Conditions will constitute, or be deemed to constitute a partnership or joint venture between the parties nor constitute or deem to constitute any party an agent of the other for any purpose.

5.4 BuyPropertyinEurope reserves the right to vary these Conditions in any way in its sole discretion including, without limitation:

6 Definitions

BuyPropertyinEurope means Buy Property In Europe Ltd.

The BuyPropertyinEurope site means the website operated by BuyPropertyinEurope with the uniform resource locator http://www.buypropertyineurope.com .
